These Terms and Conditions ("Terms") govern your use of the websites triggerfishleads.com and app.triggerfishleads.com and any related services (collectively, the "Service") operated by TriggerFish Leads LLC ("TriggerFish," "we," "us," "our"). By accessing or using the Service you agree to be bound by these Terms.
You must be at least 18 years of age and authorized to enter into agreements on behalf of any business you represent in order to use the Service.
You are responsible for safeguarding your account credentials and for any activity under your account. Notify us immediately at jim@triggerfishleads.com if you suspect unauthorized use.

Specific terms of any lead-generation engagement — including pricing, lead type, volume, geography, payment terms, and service-level expectations — are set out in a separate Insertion Order ("IO") agreed between TriggerFish and the client. In the event of conflict between an IO and these Terms, the IO controls with respect to that engagement.
Unless otherwise stated in an IO, all fees are due in advance. Late payment may result in suspension of Service. All fees are exclusive of applicable taxes, which are the responsibility of the client.
The Service, including all software, text, graphics, and trademarks (other than client-uploaded content), is the property of TriggerFish Leads LLC and is protected by U.S. and international intellectual property law. Client content remains the property of the client; the client grants TriggerFish a limited, non-exclusive license to host and display such content as required to provide the Service.
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, or non-infringement. TriggerFish does not warrant that the Service will be uninterrupted or error-free, or that any leads delivered will produce any particular conversion, revenue, or business outcome.
To the maximum extent permitted by law, TriggerFish's total liability for any claim arising out of or relating to these Terms or the Service will not exceed the amount paid by you to TriggerFish in the twelve (12) months preceding the claim. TriggerFish will not be liable for indirect, incidental, consequential, special, or punitive damages, even if advised of the possibility of such damages.
We may suspend or terminate your access to the Service at any time for breach of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us. Outstanding payment obligations and any provisions that by their nature should survive will survive termination.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Dallas County, Texas, and the parties consent to personal jurisdiction in those courts.
We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, for material changes, notify account holders by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
